PREAMBLE

Princesses et Héros SAS (hereinafter “Princesses & Héros” or “the Company”) is a one-person simplified joint-stock company with share capital of €1,000, registered with the RCS of Paris under number 908 825 490, whose registered office is located at 1 rue Andrieux in Paris 75008.

Princesses & Héros has set up a website (hereinafter “the Site” or “the Platform”) accessible at this address www.princessesetheros.fr, accessible via the Internet, open to any user of this network.

The Company offers Platform users the reservation and purchase of entertainment for children's events offered by Princesses & Heroes.

ARTICLE 1: SCOPE OF THE GENERAL CONDITIONS OF SALE AND USE

The purpose of these General Conditions of Sale and Use (hereinafter “GTC”) is to define the conditions of sale under which any legal or natural person may purchase services offered by Princesses & Héros on the Site. .

The T&Cs govern sales by the company Princesses & Héros offering event entertainment services for children.

Any person wishing to access the purchase of services offered by the Princesses & Heroes Site undertakes to expressly accept and respect these T&Cs without reservation.

Consequently, the fact of reserving a service implies the full and unreserved acceptance of these GCS by the customer (hereinafter "the Customer"), and this, regardless of the provisions to the contrary which may appear on any document emanating from the Customer, including any general conditions of purchase.

Customers acknowledge having read these General Terms and Conditions of Sale and Use at the time of any reservation and expressly declare that they accept them without reservation.

However, Princesses & Héros reserves the right to modify these T&Cs at any time. In this case, the applicable GCS will be those in force on the date of the reservation. It is the Customer's responsibility to regularly consult the latest version of the T&Cs accessible on the Site.

ARTICLE 2: SERVICES OFFERED

The services offered are those presented on the Site. The formulas offered on the Site are intended for children aged 3 to 10. They include in particular offers of animations with 1 or 2 characters accompanied by a facilitator lasting from 1h00 to 3h00 or even a tailor-made service. The Customer understands that the characters presented and bookable on the Site are generic characters inspired by popular folklore not claimed as belonging to a brand or franchise.

These services are offered in the form of:

reservation for 1 character and 1 animator lasting from 1h00 to 3h00 for a session of games, make-up and photos
Additional character option for a duration of 1h00 to 3h00.
tailor-made reservation at the request of the Customer

The provisions of the Company are specified and updated with each new reservation on www.princessesetheros.fr. The services offered give rise to the reservation of an entertainment offer. In order to validate a reservation request, the Customer must choose the desired character to perform his animation as well as the desired day and time. The Customer must then fill in his personal information as well as the information on the place of the animation. The reservation request is made directly on the Site and the payment of the deposit used to validate this request is only made after having provided the requested information.

ARTICLE 3: REQUEST FOR RESERVATIONS

By phone at 07.77.60.39.52. during our opening hours Monday to Thursday from 9:00 a.m. to 6:00 p.m. and Friday from 9:00 a.m. to 4:00 p.m.

All reservation requests are made from the Site and according to the availability displayed on it. The reservation is firm and final only after receipt of the reservation confirmation email, which is sent to the Customer within 5 days of his reservation request.

Princesses & Héros reserves the right not to record a payment, and not to confirm a reservation for any reason whatsoever, and more particularly in the event of a problem of availability, or in the event of difficulty concerning the reservation received.

The Customer wishing to make a reservation request for a service must:

complete the online order form giving all the references of his order;
complete the identification form on which he will indicate all the details requested;
validate his request after having checked it;
make the payment by entering their credit card number, expiry date and cryptogram / make the payment via PayPal;
confirm their request and payment.

Any reservation request implies express and irrevocable acceptance of the prices and descriptions of the services, as well as these General Conditions of Sale and Use.

All the data provided and the recorded confirmation will constitute proof of the transaction. You declare to have full knowledge of it. The order confirmation will constitute signature and acceptance of the operations carried out.

After final validation of the reservation, Princesses & Héros sends the Customer a reservation confirmation.

ARTICLE 4: DISCLAIMER OF LIABILITY

The Customer expressly and irrevocably acknowledges and accepts the following:

The Customer acknowledges having had perfect knowledge of the nature of the entertainment offer ordered as part of the reservation made with Princesses & Héros
The Client releases Princesses & Héros, its manager and its members from all claims and legal actions relating to damage to his person or property caused in any way whatsoever arising from or due to the service provided. The Customer agrees to assume all the risks and all the consequences related to the service offered by Princesses & Héros and its site www.princessesetheros.fr.
Princesses & Héros declares that it is insured for the damage that its staff or its equipment could cause to its Customers or for any other case of civil liability of the Company's company.
Princesses & Heroes cannot be held liable in the event of an accident resulting from failure to observe the safety instructions set out in particular by the facilitator, or from the inappropriate use of the equipment.
Each reservation request on the Site entitles the Customer to choose his effective service on a specific date and time. This will take place at their home, which is indicated to us when they request a reservation. This reservation, once validated by Princesses & Héros, must take place on the date chosen by the Customer depending on the availability of Princesses & Héros. If the Customer's choice does not correspond to the availability of the Company, the service may be postponed or canceled by following our Refund Policy.

ARTICLE 5 - PERSONAL DATA

Princesses & Héros reserves the right to collect personal information and personal data concerning you. They are necessary for the management of your reservation, as well as for the improvement of the services and information that we send you.

They can also be sent to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.

ARTICLE 6: PRICE AND TERMS OF PAYMENT

The services are provided at the prices in force appearing at Princesses & Héros and on the Site, when the order is registered by Princesses & Héros. The prices are expressed in Euros including VAT.

Princesses & Héros reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time of validation of the order and subject to availability.

The payment requested from the Customer corresponds to the total amount of the purchase. No additional costs, higher than the costs borne by Princesses & Héros for the use of a means of payment, may be invoiced to the Customer.

The fact of validating your reservation request implies for you the obligation to pay the price indicated. The payment of your reservation, total or partial according to your choice on the Site, is carried out thanks to our secure payment systems.

We offer the following payment systems:

Deposit: Credit card, PayPal
Balance to be paid at the end of the service: In cash, instant bank transfer, check

In the event of payment by credit card, the Site uses a secure online payment system. This system guarantees the Client the total confidentiality of his banking information. The bank transaction by credit card, carried out between the Customer and the secure system is therefore fully encrypted and protected. The Customer's bank details are not stored electronically by Princesses & Héros.

In case of payment by bank check, it must be issued by a bank domiciled in metropolitan France. The cashing of the check is made upon receipt.

The Customer guarantees to Princesses & Héros that he has the necessary authorizations to use the payment method, when placing the Order.

Any amount not paid by the due date specified on the invoice will be increased by late payment interest. The legal interest rate is that in force on the day of the service. This interest runs from the due date until payment. In addition, Princesses & Héros reserves the right to suspend or cancel the processing of the order made by the Customer and to prohibit him from accessing the services, in the event of non-payment or partial payment of any sum which would be owed by the Customer to the Company, in the event of a payment incident, or in the event of fraud or attempted fraud relating to the use of the site and the payment of an Order.

ARTICLE 7 - WITHDRAWAL / CANCELLATION

In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from your reservation to exercise your right of withdrawal without having to justify reasons or pay penalty provided that the service has not already been provided to you in whole or in part during this period.

After this period, cancellation is possible up to 7 calendar days before the event and as follows: 30 days or more before the event: cancellation and refund possible with deduction of 20% of the deposit paid. 30 days to 7 days before the event: possible cancellation with retention of 100% of the deposit paid. From 7 days before the event: the service can no longer be canceled and the customer agrees to pay the full amount remaining.

For any cancellation or postponement request, you will need to send an email to the following address: contact@princessesetheros.fr.

In the event of exercise of the right of withdrawal, Princesses & Héros will reimburse the sums paid, within 14 days of notification of your request.

Princesses & Héros reserves the right to cancel a service if its reservation does not concern the category of the population concerned (i.e. children aged between 3 and 10 depending on the character, maximum age being written on each character sheet), if the geographical area is not respected (i.e. the place of the event is outside Île-de-France and/or not accessible by transport shared railway line) in this case, Princesses & Héros reserves the right to keep the deposit already paid. Princesses & Héros also reserves the right to cancel a service for any reason and in this case, the payment or deposit will be fully refunded to the Customer.

ARTICLE 8 - AVAILABILITY

Our services are offered as long as they are visible on the Site:www.princessesetheros.fr

In case of unavailability of a service after passage of your reservation for any reason whatsoever, we will inform you by message or by telephone. Your reservation will be automatically canceled and we will offer you an alternative date or a refund.

ARTICLE 9 - PERFORMANCE OF THE SERVICE

The services are provided to the address indicated when ordering, on the date or at the times indicated on the booking validation page.

The company Princesses & Héros cannot be held responsible for the total or partial impossibility of performing the requested service when the fault lies with the customer if he does not show up or if he has a significant delay at the place and at the times indicated when booking the service.

Any delay incumbent on the customer will not be caught up or refunded. Other types of delay will extend the service by equal time but will not entitle you to a refund.

ARTICLE 10 - CUSTOMER SERVICE

ARTICLE 11 - FORCE MAJEURE

The performance by Princesses & Heroes of all or part of its obligations may be suspended in the event of the occurrence of a fortuitous event or force majeure which hinders or delays its performance. Are considered as such, in particular, without this list being exhaustive, war, riots, insurrection, social unrest, strikes of all kinds and pandemics. Princesses & Héros will inform the Customer of any fortuitous event or force majeure within 7 days of its occurrence.

ARTICLE 12 - APPLICABLE LAW IN CASE OF DISPUTE

These T&Cs and the contracts concluded with Princesses & Héros are subject to French law and governed by the French language for their interpretation.

All disputes to which the service operations concluded pursuant to these GCS could give rise, concerning their validity, their interpretation, their execution, their termination, their consequences and their consequences and which could not have been resolved between Princesses & Héros and the Customer, will be subject to the French courts and the competent courts under the conditions of common law.

The Customer who has purchased the services online is informed that he may in any event have recourse to conventional mediation, in particular with the Consumer Mediation Commission or to any alternative method of dispute resolution (conciliation, by example) in the event of a dispute.

ARTICLE 13 - PRE-CONTRACTUAL INFORMATION / SUBSCRIBER ACCEPTANCE

If the Customer has purchased reservations on the Site, he acknowledges having had communication, prior to placing his order, in a readable and understandable manner, of these General Conditions of Sale and Use and of all the information and information referred to in Articles L111-1 to L111-7 of the Consumer Code, and in particular:

the essential characteristics of the Services, taking into account the communication medium used;
the price of the Services and ancillary costs (processing costs for example);
in the absence of immediate execution of the contract, the date or the deadline by which Princesses & Heroes undertakes to carry it out;
information relating to the identity of Princesses & Heroes, its postal, telephone and electronic contact details, and its activities, if they are not apparent from the context;
information relating to legal and contractual guarantees and their implementation methods;
the functionalities of the digital content and, where applicable, its interoperability;
the possibility of resorting to conventional mediation in the event of a dispute;
information relating to the right of withdrawal (existence, conditions, time limit, procedures for exercising this right), termination procedures and other important contractual conditions.

ARTICLE 14 - IT AND FREEDOMS

In application of law 78-17 of January 6, 1978, it is recalled that the personal data which are requested from the Customer are in particular necessary for the processing of his order and the establishment of invoices.

The Customer has, in accordance with the national and European regulations in force, a right of permanent access, modification, rectification and opposition with regard to information concerning him.

This right can be exercised by writing, by mail and providing proof of identity, to Princesses & Héros, 1 rue Andrieux, Paris (75008) FRANCE or to the electronic addresscontact@princessesetheros.Fr.

ARTICLE 15 - INTELLECTUAL PROPERTY

All elements of the site www.princessessesetheros.fr are and remain the exclusive intellectual property of Princesses & Héros. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site whether software, visual or sound. Any simple or hypertext link is strictly prohibited without the express written consent of Princesses et Héros SAS.
